| | 21st Century Latest Insurer to Take Overtime-Issue Lawsuit Hit By John Millrany - July 12, 2001Just on the heels of a nasty judgment against Farmers
Insurance Exchange for lack of a fair overtime policy for claims
adjusters, a lawsuit has been filed on similar grounds against 21st
Century Insurance Group.
On the day before this latest suit, filed yesterday, an
Alameda County Superior Court jury throttled Farmers with a $90 million penalty
for not compensating claims adjusters for overtime because the employer
considered them non-exempt workers. The jury took exception, Farmers
immediately yelled foul and plans an appeal.
The suit against Woodland Hills-based 21st
Century is one more in at least nine others pending against insurers in a
state, which traditionally favors white collar workers’ interpretation of what
justifies overtime status. The action was taken on behalf of two 21st
Century employees.
As the various suits go forward, Joe Beachboard,
publisher of the California Employment Law Letter, predicted that
class-action overtime-suits against companies rank as their No. 1 litigation
risk. |
