| | Doctoring Up a Legion Claim By Robert Warne - April 28, 2003The timing of a settlement and liquidation order couldn’t have coincided in a more harmonious payout for one claimant.
A Yuba City nurse, Mary DeWitt has an open claim with Legion Insurance Co, as a result of a sexual harassment incident in 1999.
DeWitt, a Fremont-Rideout Health Group employee filed a work comp claim after she was exposed to the Fremont Medical Center chief of staff’s hands on approach to employee relations.
According to court papers filed by Legion attorney, Ronal Briggs, Dr. Douglas G. Tolley Jr. approached DeWitt, put his hands on her buttocks, brushed up against her breasts and asked what additional cosmetic surgery she may have had.
According to the Appeal-Democrat, Tolley even confirmed that the accusations were correct.
So far DeWitt has received about $115,000 in workers' compensation benefits, which isn’t a static figure.
A civil settlement was reached April 22 with Tolley, the same day that the matter was scheduled to go before Sutter County Judge Chris Chandler. The settlement details were sealed, but it is estimated the amount ranged between $50,000 and $200,000.
Also last week on April 25, California Insurance Commissioner John Garamendi obtained a liquidation order for Legion and Villanova Insurance Companies to kick start payments on 11,000 claims in the state.
With damages related to DeWitt’s sexual harassment incident still accruing, as a result of the liquidation order the California Insurance Guarantee Association will continue to nurse her claim.
