| | A Rater’s Rating of AB 749 By Robert Warne - April 18, 2002It’s still too early to grasp the full impact AB 749 will have on claims. Despite cost saving measures in the legislation, the bottom line is, claims are going to get pricier. As the effective date of this legislation fast approaches, one person is not just holding his hands over his head with his eyes closed.
Luis Pérez-Cordero is an independent disability-rating specialist who can be described as a professional who is passionate and outspoken about disability rating. In March he released an analysis of how AB 749 would affect rating in California.
In his report titled, “Impact of AB 749 on the Misuse of The Rating Concept ‘The Greater and ½ of The Lesser,’” Cordero compares the current rating standards of compacting progression versus the future rating practice of a pyramided or compounded rating standard (the greater and ½ of the lesser).
He provides cost analogies for no heavy work and weight-bearing restrictions, and for multiple subjective factors in an upper extremity.
Cordero said, “Maybe it is time we all seriously consider an alternative to the Rating Schedule. Californian’s can no longer afford its continued politicization to meet ‘back door’ demands that go above and far beyond what this instrument was intended for!”
Cordero’s background includes a stint as a state rater for the Disability Evaluation Unit. He has also worked for insurance carriers, self-insured employers, and third party administrative agencies. Since 1994 Cordero has worked independently as a permanent disability rating specialist, consultant, teacher and speaker. He has also published a series of manuals and articles on permanent disability.
A Puerto Rican native, Cordero is decorated with a variety of certifications, including a BA and an MA in education from the University of Connecticut. His mission is to help people rate disability according to the California Code of Regulations and the Labor Code. |
