The Nova Scotia government is bringing in legislation that will allow workers who experience a significant build up of mental stress over the long-term to claim workers' compensation.
What's referred to in the legislation proposal as gradual onset stress will be submitted to the Workers' Compensation Board of Nova Scotia for approval.
The current injury benefits for work place stress cover only an acute reaction to a traumatic event. It is stated now that such a legislative change would bring Nova Scotia in line with other jurisdictions across Canada. But it would be the first in the Atlantic provinces.
Examples of long-term stress include repeated exposure to trauma experienced by police and paramedics, or continuous, ongoing harassment or bullying that manifests in psychological injury.
The new coverage would be available in about a year to workers, if it's adopted. The time would permit the board to recruit specialized staff and to conduct more consultations.
Also, if adopted, workers would not be able to make claims for long term stress related to evaluations of their performance, interpersonal conflicts, or change in one's job description, according to this proposed law.
