| | CHP Captain’s Claim Just in Time For Retirement By Robert Warne - January 31, 2003A bulletproof Bakersfield California Highway Patrol (CHP) ex-captain has been dodging an impending pink slip while at the same time building a kevlar workers’ compensation claim that will guarantee him a disability retirement.
Back in November 2002, Eli Molina had his captain card pulled when his department came under fire for misuse of power and public funds.
At the same time that the CHP launched its investigation into whether criminal charges could be brought against Molina, he hired a private attorney to conduct a separate investigation to explore his options for filing a workers’ compensation claim.
Although the nature of his injuries haven’t been disclosed, his attorney David Clyde of Riverside has said they could qualify his client for a disability retirement.
CHP Commissioner Spike Helmick demoted Molina in October 2002 from the position he held since January 2001. The department reorganization and investigation was initiated after Helmick received five anonymous letters from multiple sources that detailed allegations that included officers working overtime for unauthorized activities.
Even though Molina has been on medical leave since the reorganization, and has twice resisted CHP efforts to serve him the first set of papers leading to his termination, he is still a CHP employee.
Whatever funny business was conducted down at the station, terminated or not, with claim in hand, Molina is serious about his exit strategy which has him set on a course to go out with a bang.
