California DWC Posts Proposed Copy Service Fee Schedule Regulations To Online Forum Area. Public Invited To Comment. By Press Release - February 17, 2014
The Division of Workers’ Compensation (DWC) has posted the proposed Copy Service Fee Schedule, in accordance with the latest SB 863 regulations, on the DWC website forums page. However, reader comments are not yet showing on the page.

The DWC put out a statement (Press Release) on Friday, February 14th, stating members of the public may review and comment on the proposals in the website Forum area. But this statement, as of today, is misleading because the Forum webpage requests of readers to send their comments to the email address of: DWCForums@dir.ca.gov.
To send comments to an email address is not the same as posting comments to a Forum page. Also, no comments from readers, thus far, are appearing on the page. Perhaps they will appear within the next few days after a DWC representative is able to approve and edit comments and; thus, clear them for publication.
“This Copy Service Fee Schedule will reduce litigation and will provide more certainty to copy service providers and parties in workers’ compensation cases. The flat rate will simplify the process and reduce the number of areas of disagreement,” said DWC Acting Administrative Director Destie Overpeck.
Senate Bill 863 requires DWC to implement a schedule of reasonable maximum fees for copying and related services. The fee schedule was developed in consultation with the Commission on Health and Safety and Worker’s Compensation (CHSWC).
The proposed Copy Service Fee Schedule provides for a maximum flat fee of $180 for records up to 500 pages and includes all associated services such as pagination, witness fees, and subpoena preparation. For records over 500 pages, an additional fee of 20 cents per page is allowed, with a cap of $425. Certificates of no record would be payable at a maximum of $100.
Other proposed changes include allowing DWC to bill $85 an hour instead of $40 an hour for electronic requests made under the Public Records Act, to charge $1 for CDs of these records, and to dispose of paper adjudication documents after 20 years.
Comments on the proposed Copy Service Fee Schedule will be accepted before 5 p.m. on Monday, February 24. Again, they are only to be emailed to: DWCForums@dir.ca.gov at this time.
