| | Rene Montes Finally Accepts Plea Deal From Orange County DA. Judge Agrees To A Maximum Of 12 Years In State Prison By Lonce LaMon - June 7, 2010Rene Montes, the mastermind of the AIG/Matrix embezzlement scheme, pleaded guilty today to all counts against him in Orange County Superior Court before Judge Frank Fasel in Court Room C-35. The total counts he pleaded guilty to number 122.
The break down of the counts are as follows: 59 counts of grand theft under Penal Code (PC) 487(a), 59 counts of insurance fraud under PC 550(b)(1), 3 counts of tax evasion under Revenue and Taxation code 19706, and 1 count of conspiracy under PC 182(a).
Montes also admitted to the monetary taking enhancements under PC 186.11(a)(2) for aggravated white collar taking in excess of $500K and PC 12022.6(a)(3) for a taking in excess of $1.3M and agreed to restitution of $1,776,712.55 broken down as follows: $1,179,703.36 owed to AIG/Chartis Insurance; $310,558.19 owed to Matrix Absence Management; and $286,451.00 owed to the Franchise Tax Board.
In return for his guilty plea, Judge Fasel agreed to a 12-year-ceiling on the sentence and he ordered the probation department to do a pre-sentence report and set a hearing for arguments on the appropriate sentence for July 30th 2010 in the same court room.
Rene Montes is the last of the four co-defendants to cop a plea, and now no one will go to trial. Earlier in late March, Cara Cruz-Thompson pleaded guilty to 23 counts of grand theft, insurance fraud and conspiracy for a two-year State Prison term; later in April, Hector Porrata, Cara's husband, pleaded guilty to 101 counts including grand theft, insurance fraud and conspiracy for an eight-year State Prison term; and in early May, George Martinez pleaded guilty to 23 counts of grand theft, insurance fraud, and conspiracy for a two-year State Prison term.
Cara Cruz-Thompson and George Martinez are no longer in custody. They both served enough time in Orange County jail to have met the requirements of credits for time served. Both were arrested and incarcerated on May 6th 2009, and released one year and a day later on May 7th 2010. Hector Porrata will soon be transferred to State Prison to serve out the remainder of his sentence. If all goes well for Porrata, with good time/work time credit for time served, he could possibly be out of prison in three more years.
