Charges Dropped Against CHP Dispatcher Targeted In Fraud Probe By Associated Press - November 21, 2005
SACRAMENTO (AP) _ Prosecutors have dropped all fraud charges against a California Highway Patrol dispatcher who claimed she had a back injury but was later videotaped riding horses.
Barbara Fogarty was charged with 10 felony counts of workers' compensation fraud after months of surveillance.
Her attorney said the prosecutors' case in Shasta County fell apart because physical therapists said videotapes of her riding horses weren't inconsistent with her claim of back injuries.
"I think the handwriting was on the wall that this was a case that wasn't going to fly," attorney Joseph Gazzigli said.
Only one other case put together by the CHP's newly revived workers' compensation fraud unit has resulted in charges. The CHP claims the fraud unit and the correct use of the workplace injury system has led to a drop in fraudulent claims.
