| | Senate Passes Sweeping Patients' Bill of Rights By John Millrany - July 2, 2001Although under the threat of a presidential veto, a sweeping
patients’ bill of rights was passed by the newly Democrat controlled Senate
June 29. The vote was 59-36.
If enacted as written, the bill would give the more than 190
million Americans with private health insurance greater latitude in suing
health management organizations (HMOs) in the event of denying or delaying
treatment.
The bill now goes to the House for consideration.
“(Friday’s) vote brings us a giant step closer to
guaranteeing that millions of Americans will no longer be powerless when their
HMOs overrule their doctor and deny needed care,” said Sen. Edward M.
Kennedy (D-MA), the bill’s co-sponsor.
Meanwhile, the US Supreme Court said it will take up,
in the next term, the question of whether states can set up independent panels
of doctors to review legally the medical decisions of HMOs.
