An Aug. 28, appointment has been set for a doctor—in trouble for liberally prescribing MRI’s and dye injections for workers’ compensation claimants—to tell his side of the story to the state Medical Board.
Dr. James Stakely’s medical license was suspended Aug. 8 after he was arrested June 4 by Department of Insurance investigators and charged with 23 felony counts of workers’ compensation fraud.
Accused of aggressive billing for unnecessary services or procedures never performed, Stakely is expected to argue at the show/cause hearing why he should be able to continue practicing medicine while the Medical Board reviews his case.
But even if Stakely persuades the board to reinstate his license, he will still have to go before a criminal judge Oct. 14 and justify that his style of industrial medicine falls within the bounds of the law.
This may be difficult though because prior to his arrest two different investigators with bogus injuries visited Stakely at his Industrial Physician Medical Group in San Diego.
Neither investigator was ever examined by Stakely. But that didn’t stop him ordering a round of dye injections for the undercover agents whom he told would be eligible for a permanent total disability retirement and compensation package.
