| | Two More Patients' Rights Amendments Defeated by Dems By John Millrany - June 27, 2001The new Democrat-controlled Congress for the second time has held off the GOP’s intention to prevent full immunity from workers’ compensation lawsuits pertaining to patients' bill of rights legislation.
In a 56-53 vote June 26, an amendment crafted by Sen. Phil Gramm (R-TX) was prevented from granting employers absolute protection from lawsuits by workers or their families covered by employer-sponsored health insurance.
Today, a second amendment, relating to smaller companies, was also shot down in a 53-45 vote. The proviso, advanced by Sen. Wayne Allard (R-CO), would have excluded employers with fewer than 50 employees from lawsuits by workers or families.
After the wrangling, GOP leaders implied that Democrats were spoiling to force a presidential veto over the patients’ rights issue.
Meanwhile, moderates from both parties are trying to invent a compromise before final resolution of the question—which essentially asks whether patients have the right to bring lawsuits with no monetary cap and, if so, will this create potentially devastating damage to the American economy. |
