| | Cart That Killed Boy Center of Suit Against LA Schools By John Millrany - July 11, 2001A wrongful death suit that could seek up to $84 million in damages was filed July 10 against the Los Angeles Unified School District by the parents of 7-year-old Steve Silva, who was killed by a 1,300-pound electric utility cart.
The suit, filed by Enrique and Juana Silva, alleges that inadequate supervision occurred when a maintenance worker had parked the cart during an after-school program Sept. 15 at Roscoe Elementary School in Sun Valley. According to police reports, children began playing on the cart after 3 p.m. when it began to slide down a shallow incline after a child pulled the hand brake.
Reports said the second-grader Steve apparently tried to stop the cart by jumping in front of it. Pinned to the wall, he sustained massive head injury. He was in full cardiac arrest when paramedics arrived, and was pronounced dead at Providence St. Joseph Medical Center in Burbank.
One of the Silvas’ attorneys stated that the accident could have been avoided with proper supervision. The school district has yet to comment on the suit filed in Los Angeles Superior Court.
The district has conducted an internal investigation but hasn’t released any findings. LAPD’s Valley Traffic Division found no evidence of criminal negligence.
Several days after the incident, the district provided chock blocks to schools using utility carts and ordered them placed under the wheels of parked carts as an added preventative measure. |
