Disney Settles with Family of Brandon Zucker

The Walt Disney Co. reached a settlement, Feb. 1, with the family of Brandon Zucker. The six-year-old was permanently brain-damaged when he fell out of a car on the Roger Rabbit Car Toon Spin ride in Sept. 2000.

The amount of the settlement was not announced, but lawyers familiar with similar cases say the family might have received around $20 to $30 million. That money will take care of lifelong medical expenses, loss of economic productivity and quality of life, as well as pain and suffering.

Brandon’s father, David Zucker, said the settlement is enough to take care of Brandon’s needs for the rest of his life and that was all he and his wife wanted.

Brandon went to the park with his family to celebrate his mother, Victoria Zucker’s, 40th birthday. When he got on the Roger Rabbit ride with his mother and brother, Brandon was seated on the outside of the seat near the cut out door of the car. As the car spun around Brandon fell out and landed on the tracks. He was crushed by the next car, which happened to be carrying his father and grandmother.

Brandon was folded underneath the car for more than ten minutes. He suffered internal injuries and a broken pelvis. When emergency workers freed Brandon he had no pulse. His brain damage resulted from oxygen deprivation.

Since the accident, the Division of Occupational Safety and Health ordered Disney to add automatic latching doors, sensor-equipped bumpers, plus audio safety messages and written warnings to the ride.

The case was scheduled for trial Feb. 4. The family’s lawyer, Thomas Girardi told the Los Angeles Times, “Mr. and Mrs. Zucker are massively pleased that this part of the ordeal is over. Obviously, like any mom and dad, they were not looking forward to actually going through the trial.”

Brandon is hospitalized at HealthBridge Children’s Rehabilitation Hospital in Orange. He is unable to walk or talk but responds to touch and voices. His parents told local media that he used to jump around their house punching at the air like “Rocky.” In April of 2001, Sylvester Stallone visited Brandon in the hospital. The boy smiled in response when Stallone whispered to him, “Yo! Give Rocky a punch.” Victoria Zucker told Mirror Magazine, “Mr. Stallone’s visit did a lot of good for Brandon.”

Brandon’s parents moved to Orange County from Santa Clarita to be closer to him. They hope to use some of the settlement money to move their family back to the Santa Clarita area.
