Mold claims seem to be popping up like a meadow full of toadstools all over the state these days. The potent fungus has been known to grow on a wide range of claims.
Currently the Legislature is advancing a bill that would continue to propagate mold claims. Senate Bill 1763 would prevent insurers from excluding mold coverage in property and liability policies. Specifically, if the legislation passes, carriers will be required to cover mold as an “ensuing loss” if it is caused by fire or heavy water damage.
The latest mold madness is being played out in Tulare County. Approximately 140 county employees in Visalia have been exposed to stachybotrys, a form of toxic mold. The employees are all looking for the right place to cash in their claims. Originally they all filed lawsuits against the county, but around 50 have since decided to pursue their options before the Workers’ Compensation Appeals Board.
The claimants all worked in the west wing of the Visalia courthouse where a leaky window, air conditioning and drafty roof are thought to have created the mini mold farm.
There’s no end in sight for these types of claims, so a word to the wise, when life gives you mold claims, make yogurt.
