LA Superior Court Blowout Decision

Los Angeles is known throughout the world for many different reasons (e.g., Hollywood, Lakers, earthquakes, etc.). And everyone knows Los Angeles has had its share of famous high profile court cases (e.g., OJ, Menendez Bros., Rodney King, etc.). In the liability arena, LA Superior Court has earned its share of recognition, thanks to a recent round of personal injury decisions.

In 1999 LA Superior Court drew attention in a landmark verdict. The defendant in the case was awarded the largest civil verdict in US history—a vehicle fire case the court found General Motors liable for $4.9 billion (which the judge later reduced to $1.2 billion).

On Friday, April 13, 2001 Los Angeles once again in the courts enters the record books as a verdict, largest of its type of $55.4 million for a tire blowout was awarded against Continental General Tires. The plaintiff, Cynthia Lampe, was paralyzed from the neck down in a 1996 rollover crash. This decision brings LA one step closer to earning a reputation of being a chancy place to defend personal injury cases involving tire and automotive defects.

Tire blowouts, or better known in the courts as tread-separation failure, are what brought allegations against Firestone to the forefront in 2000, prompting a massive tire recall.

In the Lampe case the jury ruled that Continental General Tires was negligent and that the tire on the defendant’s car possessed a manufacturing defect. This argument was supported from evidence presented to the jury, including testimony from former plant workers who testified it wasn’t out of the ordinary for floor sweepings and other contaminants to be dumped into the rubber mix, and such issues as pressure to produce taking precedence over quality control. A memo from a plant manger was introduced as evidence. In the memo were quotes like, "We are out of control," in regards to quality control. Also stated in the memo: "and as you can see, it is not one particular defect, but a conglomeration from every department."

Three other companies had previously settled with the plaintiff for a total of $4.09 million: Ford Motor Co., a service center at Sears, Roebuck and Co. and an unnamed dealership. Ford was accused because it included AmeriTech ST tires manufactured by Continental as a standard package for Taurus and Mercury Sable models. The Sears service center was accused because Lampe’s tires were inspected there prior to the accident. The dealership was accused because it had sold the used car to Lampe’s family.
