| | Sacramento Seeks Subrogation From Rent-a-Cop Company By Robert Warne - September 10, 2002Subrogation is written all over a lawsuit filed Sept. 6 in the Sacramento Superior Court. The city of Sacramento is seeking $113,225.95 from Burns International Security, a company employed to protect the city.
Last year Joseph Ferguson a 20-year-old security supervisor for Burns went on a shooting rampage and took the life of one municipal employee and the lives of four other private citizens.
Deputy City Manager Betty Masuoka told the Sacramento Bee that the city is exercising its right under the state labor code to be compensated for a benefit payment it made.
“With worker's compensation benefits paid out, we try to recover as often as possible from third parties where there is possible liability on their part,” she explained to the Bee.
The city wants Burns to be held liable for the death of 19-year-old John Glimstad, a city shift worker who worked at the Miller Park marina.
In the suit, Burns is accused of not informing city officials that Ferguson had been suspended for attacking a co-workers’ car with an ax a week before the rampage.
The suit states, “Burns was required to provide the city with security services to prevent the type of damages and harm which happened in this case.”
The city plans to still employ Burns security guards. It just wants to collect money for the isolated incident for which the city believes it isn’t liable for. |
