| | Peyman Heidary Arraignment Continued In Riverside To August 19th. Both Heidary And Abramowitz Out Of Custody Since May 20th 2016. By Lonce LaMon - June 7, 2016
The arraignments for the seven current defendants in the Peyman Heidary, D.C. case in Riverside County Superior Court at 4100 Main Street, downtown Riverside, were scheduled for this morning in Department 64 at 8:30 am. Those arraignments have now been continued to August 19th 2016. Other motions may be interspersed prior.
Two cases were filed on May 16th 2016 by grand jury indictments. Case number RIF 1670175 is for 60 counts against four defendants: Peyman Heidary, Cary David Abramowitz, Ana Solis, and Gladys Ross. Bail amounts of $12,402,000 were set for each of these four defendants.
A separate, companion case numbered RIF 1670176 is an Indictment against Touba Pakdel-Nabati, Quynam Nguyen, and Jason Yang. Equal bail amounts were also filed against each of these three defendants for $12,402,000.
A previous case was filed by the Riverside County District Attorney in July of 2014. That case was not generated by a grand jury. The defendants in that case were Peyman Heidary, Cary David Abramowitz, Erica Torres, and Michael Tuosto.
Erica Torres and Michael Tuosto entered guilty pleas. Their bail amounts started at only $50,000 and the judge reduced them sufficiently in order that they were able to post bail.
That 2014 filed case will be superseded by these new Indictments which will bring about its dismissal. Michael Mayman, the Deputy District Attorney who was prosecuting that previous case, has retired. These new Indictments are now being prosecuted by Erika Mulhere, Matthew Murray, and Raymond Ramirez.
Peyman Heidary and Cary David Abramowitz have not entered guilty pleas. The Riverside County Sheriff’s Department “Who’s In Jail” website shows that Peyman Heidary was arrested on May 17th 2016 and released on May 20th 2016. No information on his bond is given in his record, therefore the only conclusion implied is that he was able to make a bond on a $12,402,000 bail amount. That’s shockingly unbelievable, but more information on this bail subject will be pursued moving forward. Cary David Abramowitz was also released from custody on May 20th 2016 on an equal bail amount.
The Riverside County District Attorney’s office spokesperson, John Hall, stated that their office has large cases which they may decide to take to a grand jury in order to speed up the process. Using a grand jury by-passes the Preliminary Hearing stage and takes the case directly to trial status. It can be assumed that these two new Indictments were generated to push this case forward and to consolidate it as the investigation pulled in the new defendants.
All the charges were manifested out of the medical mill operation spearheaded by Peyman Heidary. He engaged cappers and pulled other medical providers into his scheme.
He organized and routinized the old cliché of sending all patients to all the multiple specialists regardless of their injuries. The bills were thus greatly inflated, and if the claims payers didn’t pay, they filed a lien with the WCAB. Then the bills were sold to a third party at a reduction, an action known as “factoring”. Then the third-party would continue to attempt to collect on the bills and liens. Then the insurance payers would settle in order to avoid inevitable potential penalties. It’s the tired old circle of abuse.
The first indictment, case RIF1670175, charges chiropractor Peyman Heidary, 45, of Riverside; attorney Cary Abramowitz, 59, of Los Angeles; and also Ana Solis, 34, of Rancho Cucamonga; and Gladys Ross, 53, of Simi Valley, with 69 felony counts which include conspiracy to commit insurance fraud, making a false insurance claim, making a false statement for the purpose of obtaining workers' compensation benefits, money laundering, practicing medicine without a license, and capping. There also is one misdemeanor count of unlicensed practice of law.
The second indictment, case RIF1670176, charges chiropractor Touba Pakdel-Nabati, 37, of Costa Mesa; and doctors Quynam Nguyen, 57, of Orange; and Jason Yang, 50, of Pasadena, with 38 felony counts which include conspiracy to commit insurance fraud, making a false insurance claim, making a false statement for the purpose of obtaining workers' compensation benefits, and capping. Both indictments also allege multiple excessive takings enhancements and an aggravated white collar crime enhancement.
If convicted as currently charged, Heidary faces a potential maximum sentence of 97 years and 4 months in state prison; and Pakdel-Nabati, Nguyen, Yang, Abramowitz, Solis, and Ross each face a potential maximum sentence of 63 years and 4 months in state prison.
