WCAB’s Final Rules Published and Will Become Effective January 1, 2015 By Lonce LaMon - October 18, 2014
The Workers’ Compensation Appeals Board (WCAB) has adopted its final Rules of Practice and Procedure (Rules). The Office of Administrative Law has filed the WCAB’s new Rules with the Secretary of State and they were published October 15, 2014. The new Rules will become effective on January 1, 2015.
The primary purpose of this rulemaking was to repeal the Rules of the Court Administrator and to move the non-duplicative rules into the WCAB’s Rules. These changes are authorized by Assembly Bill 1426 (Stats. 2011, ch. 639), which eliminated the position of Court Administrator and deemed the Court Administrator’s regulations to be regulations of the WCAB. The rulemaking also made largely non-substantive changes to a limited number of existing WCAB Rules.
