Macy's To Pay Nearly 1 Million Dollar Fine After Crushing Death And Decapitation Of Factory Worker By Lonce LaMon - August 14, 2014
A $950,000 fine became part of a settlement agreement on Monday against Macy’s Corporate Services, Inc. over the death of an employee who was decapitated by machinery at a distribution center. The fine will be paid at a sentencing hearing scheduled for August 15th.
Roy Polanco was operating a cardboard and compactor machine in East Los Angeles on July 13th 2009 when he fell into an unguarded opening in the unit. He was decapitated by the machine’s hydraulic compacting ram. He was crushed to death. He was 65 years old.
The machine, a baler, is used to compact waste for recycling. Polanco fell into a baler that had been modified to operate without interruption.
On Monday, also, Macy’s pleaded no contest to a misdemeanor count of corporate criminal liability. Macy’s must as well conduct an audit of balers and compactors at its California stores and distribution centers under the approval of the Los Angeles district attorney’s office.
