| | Aspen Medical Owners And Their Collector Plead Not-Guilty In Orange County Superior Court Today To $36 Million In Overbilling To Workers’ Compensation Carriers And Self-Insureds. By Lonce LaMon - April 25, 2014
This morning at 9 am in court room C-30, before the Honorable John Conley in Orange County Superior Court in Santa Ana, the four Aspen Medical Resources defendants Landen Mirallegro, Jeffrey Campau, Abraham Korshad, and Ryan McCracken pled not-guilty.
The four defendants all appeared in court wearing dark suits. They sat waiting for their case to be called spread out along the back row against the wall, each one with a seat or two between them. Jeff Campau sat nearest the door, then Ryan McCracken sat with a seat between him and Campau, then Abraham Khorshad was another two seats away, then Landon Mirallegro was on the end deepest into the room.
Kay Rackauckas is Landon Mirallegro’s attorney and her diminutive figure appeared wearing a brown suit. Shaddi Kamiabipour appeared in a black and white dress as the deputy district attorney representing the People. Paul Meyer is legal counsel representing Jeffrey Campau.
Meyer spoke and stated the defense was still reviewing transcripts. He requested a time waiver, which the judge approved and then he recited it for all the defendants. The next court appearance is set for July 11th 2014 for pre-trial proceedings. A further waiver was requested to allow the defendants not to have to appear in court at every time there is a hearing.
Kay Rackauckas, Landon Mirallegro's defense counsel, leaves through the back entrance of the Orange County Courthouse at 700 Civic Center Drive in Santa Ana. Her client and the other three defendants pleaded not-guilty this morning.
Not all the defendants are included in all 49 felony counts of the indictment filed by the Orange County District Attorney last October of 2013. Ryan McCracken, who was the hearing rep/collector for Aspen Medical and collected under other business names, as well, is out of custody on only $20,000 bail and was not an owner of any of the Aspen network of companies. Landen Mirallegro, Jeffrey Campau, and Abraham Korshad all held ownership and are all out of custody on 1.5 million dollars bail each. The Orange County District Attorney has seized all the assets of the companies.
Aspen Medical predominantly and almost exclusively billed for a hot-cold physical therapy machine valued at between $250 and $500 for purchase. This machine was rented for use by claimant-patients regularly for tens of thousands of dollars within a one month period. One attorney who wrote to adjustercom stated she received a bill in excess of $18,000 from Aspen on one of her files for a two week period for just a rental of a hot-cold physical therapy machine.
Aspen is a Durable Medical Equipment (DME) company based in Anaheim, California.
