This morning of the first day of Kelly Soo Park’s trial opened rather quietly. Kelly Soo’s ample entourage wasn’t present. It was just she and her faithful husband, Tom Chronister, who has just completed suing the City of Oxnard and the Oxnard Police Department for taking disciplinary actions against him over his association with Kelly Soo. He filed the lawsuit on May 2nd. It was well reported in the Ventura County Star.
Some happenings from last week came as a surprise to this writer. Last Thursday and Friday there were two pre-trial hearings, both unannounced at the February 28th pretrial hearing when the May 12th trial date was set. Material was presented by the defense to the judge. Kelly Soo Park’s attorneys tried to introduce evidence of a police video of John Gilmore, who was intimate with Juliana Redding just before her murder.
This court room happening was told to this writer by Trials & Tribulations writer, Betsy Ross, found on the web at www.sprocket.trials.blogspot.com. She attended those last Thursday and Friday hearings, whereas this writer did not.
During this police interview, John Gilmore was upset and speaking unintelligibly. He was not clear while not in complete command of himself. Buehler and Kassabian brought in this so-called “audio-expert” who enhanced the sound, slowed it down, beefed it up, and this audio was played to the court room. The forensic audio expert said he could hear John Gilmore say towards the end of the recording: “I did it.” In other words, he killed Juliana Redding.
The audio expert said to Judge Kathleen, can’t you hear him say that? and she responded that no she couldn’t. And the audio expert said that he was surprised that she could not.
Judge Kathleen Kennedy won’t allow this material as evidence. So, court proceedings started off around 9 am with a barrage of motions from the defense. Kelly Soo’s attorney, George Buehler, expressed his concerns that her constitutional rights would be violated as she now had no defense. So he hinted that the trial could be further delayed, but Judge Kathleen would have none of it. The trial was going to proceed. And it did. But nothing Buehler and Kassabian presented last week is being allowed into evidence as Judge Kathleen says it doesn’t reach the threshold of the necessary burden of evidence. He can’t even use any of it in his opening argument as part of his story.
Jury selection began by the late morning. A swarm of humanity of all ages, races, nationalities, genders have presented themselves as potential jurors. The selection process will continue tomorrow…
