Ohio Judge Considers 860 Million Dollar Demand By Employers For Workers’ Compensation Premium Overcharges By Lonce LaMon - March 15, 2013
A northeast Ohio judge is contemplating arguments from employers who say they’re owed 860 million dollars in overcharges by the Ohio Bureau of Workers’ Compensation.
The employers claim is based upon a ruling by Judge Richard McMonagle of Cuyahoga Common Pleas Court, who ruled on the case back in December 2012, that they were overcharged from July 2001 to June 2009 by the Workers’ Compensation Bureau. Attorneys for the employers state the 860 million amount is needed to repay as many as 270,000 Ohio employers.
The employers demanded 1.3 billion dollars originally and then revised that amount. The state is pleading with arguments for a lesser amount. Yesterday, an evidentiary hearing began in Cuyahoga County.
The lawsuit was filed by a group consisting mostly of small businesses. The group alleged that the Ohio Bureau of Workers’ Compensation gave discounted premiums for Workers’ Compensation to companies that joined for group insurance plans but charged companies not in the groups excessive rates in order to pay the discounts.
