Kelly Soo Park Trial Pushed To May 13th. Judge Accuses Defense Of Shenanigans. Prosecution Loses Motion To Admit Other Crimes.

The judge vituperated Kelly Soo Park’s defense lawyers yesterday morning for further delaying the trial date as the parents of victim Juliana Redding, Patricia and Gregory Redding, sat with their family and friends in the second row of the court room of the Honorable Kathleen Kennedy in Downtown Los Angeles at Clara Shortridge Foltz Criminal Justice Center, Department 109.
 
Judge Kathleen reamed George Buehler by accusing him of engaging in “shenanigans and foot dragging”.  She railed eloquently giving a harsh dusting off by stating, “I’m very disappointed that this case is not ready to go to trial.  I rearranged my other cases so that this case could be tried at this point.  I want this case to go to trial.  Your client changed lawyers three times.  She has no interest in this case going to trial.  You have no interest in this case going to trial!”

Aspiring actress and model Juliana Redding was murdered in her apartment in Santa Monica, California on March 15th 2008.   This judge has repeatedly in prior hearings lectured that this is now an old case and needs to get to trial.
   
Buehler defended himself by replying, “There have not been any shenanigans.   What happened was beyond my control.  I have no interest for this case to be dragged on.”  He further expressed that he did not cause the delays intentionally.

Judge Kathleen snapped back, “I think you did it intentionally!”
 
“I can understand the court’s frustration,” Buehler spoke gently like a dog with his tail between his legs. 

The delays have been caused by another impending trial George Buehler is on plus the fact that he and his partner, Mark Kassabian, started more DNA testing late in the game.  The judge asked, “Why wasn’t the DNA done earlier?”  And Buehler replied that it should have been done but hadn’t gotten done by previous counsel, however Deputy District Attorney Stacey Okun-Weise reminded Buehler that months prior he said he wasn’t going to do further DNA testing but then changed his mind and decided to do more DNA testing.  Thus, now everyone is still waiting on the DNA test results.

Buehler expressed, “We’ve been on this case less than a year,” but to that Kathleen Kennedy retorted, “That doesn’t mean this case can be continued forever!”
 
Another factor is now affecting the trial date in that the District Attorney’s criminologist  will be out of town from the end of April to May 10th.  Stacey Okun-Weise wants her criminologist to come back and be available for her at the trial.  Thus, finally after many vituperations, reprimands, and contentions a firm date has been set for May 13th 2013.  It was stated by the judge, “The 13th of May is a firm date.”
 
Kelly Soo Park leaves the Downtown L.A. criminal court house with her first attorney, Kay Rackauckas, on February 8th 2011.  Kay and her law partner, Jennifer Keller, resigned from Kelly Soo's defense in May of 2011 over the conflict-of -interest of Dr. Uwaydah paying them for her defense.   Dr. Uwaydah is now paying Buehler & Kassabian but Buehler & Kassabian don't mind the conflict and are sticking with the case.  Kelly Soo signed a waiver of conflict-of-interest in order to stick with B&K in October of 2012. 
 
The Prosecution filed a Motion To Admit Other Crimes, so the judge heard the DA’s oral argument followed up by the defense’s argument against admitting these three other crimes as evidence in this case.

Stacey Okun-Weise spoke articulately as she explained to the court that Dr. Munir Uwaydah and Kelly Soo Park threatened three people with reprisals by trying to scare them into not reporting on their understandings of Uwaydah’s and Park’s frauds.   Uwaydah and Park tried to shut them up.
 
Dr. Uwaydah’s big worry was that Jerry Lukowski, Michael Miller, and Erin Kelly had material knowledge of his fraudulent activities and were going to talk.   And this is exactly like the material Greg Redding had on Uwaydah.

Dr. Uwaydah wanted Greg Redding, a pharmacist, to make compound medications as creams for him to prescribe to his workers’ comp patients and charge exorbitant rates for to workers’ compensation carriers and self-insured employers.  According to Stacey Okun-Weise, “Greg Redding did his research on Dr. Uwaydah and felt that he wasn’t standing on legal ground. “ According to Greg Redding it was all fraudulent activity.  “Redding was not going to be a part of it.”
 
Stacey Okun-Weise spoke of how Greg Redding was close to his daughter Juliana.  “What better way to get to a parent than through the child?” she told the court.  She brought up as relevant the recent early February 2013 case of Christopher Dorner, the ex-cop who killed four people out of revenge, one including the daughter of the LAPD Captain he most resented.

“This is a group of unscrupulous individuals,” Okun-Weise said referring to defendant Kelly Soo Park, her then-boyfriend Ronnie Wayne Case, and Dr. Munir Uwaydah.  “The motive behind the defendant may not have been to kill her (Juliana Redding), but it was to intimidate her.”
 
Dr. Uwaydah had big concerns about people talking to the authorities when they caught on to his fraud games, according to the DA’s argument.  “That’s his concern.”  Okun-Weise cited how Ronnie Wayne Case and Kelly Soo Park were arrested after the conflicts and reports from Jerry Lukowski.  She stated that right as the Jerry Lukowski conflict unfolded, “Dr. Uwaydah is on the wire to Ronnie Case.”
 
George Buehler then replied representing the defense, “This is all speculative.  The DA is trying to argue Ms. Park has prior incidences.  Dr. Uwaydah feared some sort of disclosure.  There’s no evidence.  No testimony.  So the DA’s theory is entirely speculative.”
 
Buehler went on to state that he believes “the problem the People have here is a gap in their evidence.  I think the People are way off-base.  Clearly bringing this sort of evidence in will make Kelly Soo Park look like a bad person.  The People are trying to contrive a reason to make Park look bad.  It’s all rank speculation.”
 
Buehler brought up the case of Phil Specter, how Specter had seven prior incidences of acting with the same anger and rage when the women tried to leave his home.  “Because of similarities you can draw the inference.  But there is no similarity here.  The People want to speculate.”
 
Judge Kathleen Kennedy listened to both arguments and then concluded that she thought the People had not met their burden to have the prior incidences entered as evidence into their case.  “The court is going to deny the People’s motion.  They have not met their burden.”
