Class Action Lawsuit Filed Against Intercare Holdings, Inc. For Adjuster Overtime Pay

Right in the wake of a California Appellate Court Decision declaring that claims adjusters are production employees entitled to overtime pay and not exempt, a class action lawsuit has been filed against a third-party-claims-administrator, Intercare Holdings, Inc. 
 
On August 7, 2012, this class action was filed on behalf of two former Intercare adjusters alleging that they worked in excess of 8 hours a day and in excess of 40 hours a week without receiving overtime pay.  The lawsuit alleges that adjusters in Intercare’s Pasadena office were even provided Citrix (computer) remote access so that they could continue to work from home into the night or during the weekends. 
 
However, no matter how many hours the adjusters worked, the suit further alleges, they had to complete timecards indicating that they worked 8 hours a day.
 
Many of us may relate to filling out timecards and only putting 8 hours for several reasons, such as supervisors telling us it does not matter how many hours we put on the card because we get paid the same amount, or that working unauthorized overtime will result in disciplinary action because overtime needs to be approved. 
 
Bottom line: in the work comp claims industry, 8-hour days are basically nonexistent if an adjuster is working a case load of or in excess of 180-200 files. 
 
For those of us who have 200+ files to manage, 10+ hour days are the norm.  Some colleagues stay until 7 or 8 at night and work on the weekends just to try and keep up with the caseload. 
 
We see friends and coworkers who experience “burn-out” from being overworked and either go out on stress leave or get terminated for falling behind with their work.  Yet this has been the status quo in our industry without any relief on the horizon.
 
My sincere hope is that claims adjusters receive fair treatment and that they be neither overpaid nor underpaid.  I advocate they be allotted manageable caseloads and paid overtime, when needed.  
 
I hope expressed communication from all sides together with the legal system will come together in a fair solution for all concerned in the business of handling workers’ compensation claims.
