Ohio Offers Bill To Senate To Prevent Illegal Workers From Collecting Workers' Compensation

In the state of Ohio, legislation is presently being considered by the senate to make undocumented workers injured on the job not eligible for workers’ compensation. 

Senator Bill Seitz, who is a Republican from Cincinnati, has proposed Senate Bill 323.  He put together this bill after learning that the Ohio Bureau of Workers’ Compensation is not required to ensure the citizenship of injured workers filing claims. 

“Legal workers have every reason to be concerned that our workers’ comp system will have enough to pay their injury claims,” Bill Seitz told the members of the Senate’s insurance committee, where the legislation had its first hearing. 

If the legislation passes it will require all workers filing workers’ compensation claims to verify they are eligible to work in this country using the same verification process required for filing unemployment claims. 

Those who cannot provide the proper documentation for legal work or who falsify documentation will not receive indemnity payments for temporary disability, medical treatment, or any other workers’ compensation benefits.  According to Seitz, similar laws have been enacted in Florida, Idaho, and Wyoming.

Senator Seitz expressed that illegal workers would still have some recourse if their employers hired them knowing they were not legally allowed to work in this country.  "Through this mechanism, we will deter unscrupulous employers from knowingly hiring illegal aliens and prevent them from passing the cost of their own illegal decisions onto employers who are following the law.”
