|Orange County Case Against Sim Hoffman, M.D., And Other Defendants Continued Once Again. New Arraignment Set For January 6, 2012|

On October 28, 2011, the case of The People versus Sim Hoffman, M.D., Thomas Heric, M.D., Beverly Mitchell, and Louis Santillan was continued once again in Orange County, California, Superior Court. The last continuance occurred on August 19, 2011.
There was a motion again by the defense to continue the arraignment. The next date for the arraignment on the 800 plus count indictment by the Orange County District Attorney’s office has been set to January 6, 2012 at 9:00 am in court room C-40 at the Central Justice Center in Santa Ana.
During the last court appearance on August 19, the defense had collectively filed a 995, which is essentially a request for the judge to dismiss one or more counts of the Complaint. The Complaint was amended in early August from the one originally filed in May 2011.
There are 80,000 pages of discovery, and the defense attorneys are evaluating each count in order to challenge the evidence justifying all the counts. With over 800 counts, this will be a very lengthy process. Some of the defense counsels consider some of the felony counts to be misdemeanor counts.
Henceforth, no pleas have been entered as of yet.
At the August 19th hearing, Judge William R. Froeberg stated, “Each party is going to have to do their own 995. I need a spread sheet to show what’s being challenged and why evidence is insufficient. Anything else, and I will go crazy in the legal sense.”
Sim Hoffman, M.D., a radiologist, Thomas Heric, a neurologist, Beverly Mitchell, office manager, and Louis Santillan, bill collector and lien advocate have been indicted for workers’ compensation fraud. Sim Hoffman ran Advanced Professional Imaging and Better Sleeping Medical Center in Buena Park, California.
All the defendants were arrested and incarcerated after the indictment was presented in May of 2011. All are now free after having posted bail soon after their incarcerations.
