Prometheus The Trickster, aka Munir Uwaydah, M.D., Bamboozles The Los Angeles Superior Court Into A Fraudulent Six Million Dollar Judgment Against A Beirut Businessman. Part II

So, here we are.  It’s late 2009, and Munir Uwaydah, M.D., and his alter ego shell corporation, Prometheus Health Imaging, Inc., have succeeded in getting a six million dollar civil judgment against Khaled Ghandour, a Lebanese businessman, in the Los Angeles Superior Court branch in Santa Monica, California.  And he did it all fraudulently. 

But let’s look at this a few ways; seeing what the possibilities could be.  Let’s imagine that Khaled Ghandour is a liar, which isn’t likely, but let’s imagine it anyway—just for argument’s sake and in order to shine a light everywhere we can in order to do diligence.  If Ghandour is lying and really does have a residence in the Los Angeles area, contrary to his statements that he does not, and is a businessman with projects in California and possibly in other places of the United States, then he is going to have assets in the United States, most likely property and bank accounts. 
 
So, obviously, if Ghandour refuses to pay, Uwaydah can then put liens on Ghandour’s properties, and he can secure levies on his bank accounts. This is typically what is done when collection becomes a problem for any winner of a court judgment.
 
But, it seems unlikely that Ghandour really has any properties in California, because Uwaydah used Kelly Soo Park’s address to serve Ghandour with the Complaint.  If Ghandour really had a residence or business property in the L.A. area, wouldn’t Uwaydah use Ghandour’s real address and not Kelly Soo Park’s?  So, this screams that Uwaydah absolutely knew that Ghandour had no property or residence, business or personal, in Southern California.  And he didn't want him to have any because he wanted an actor to play him in court. The last thing Uwaydah wanted was to have the real Khaled Ghandour anywhere around.  And he certainly didn't want him showing up in court.

So, why would Uwaydah do this and waste his time on getting a judgment he could never collect on? What would be the point?  Why would Uwaydah play a scam and work so hard to get a judgment against Ghandour in Los Angeles when he knows Ghandour has nothing in L.A. or even perhaps the entire United States to lien against or levy?
 
Because Uwaydah wanted to use the L.A. court judgment to influence and manipulate the court in Beirut, Lebanon.  He could make an excuse to the Beirut court, in his usual and customary fashion, as to why he couldn't appear in person, and use the L.A. County Superior court judgment as evidence to be put before the Beirut court.
 
 
Uwaydah also sued Ghandour in Beirut, as was stated in Ghandour’s answer which most likely did not get into the official record to be seen by the Judge in Santa Monica.  Ghandour stated, “Plaintiff has already filed a lawsuit against Defendant in front of the Lebanese courts.”  So, Ghandour sued Uwaydah in Beirut and most likely Uwaydah countersued to that suit.  That’s likely what happened. 
 
Uwaydah wants to send that fraudulent L.A. Superior Court judgment to Beirut to further his case there, as he wants to use the judgment as testimony.  You see, he doesn’t want to show up in court in Beirut either.  He never wants to appear in any court anywhere in the world; however, he wants to run around the world and win judgments against people by never making any appearances in the flesh.  He wants to be the Invisible Man.

He used the excuse in Santa Monica that he had just had open heart surgery, so he could manipulate his way out of having to personally appear. Uwaydah never shows up for any of his depositions or his court appearances.  It’s his pattern and practice.  And here’s why.  
 
Because he is a liar.
 
Liars can never look the other person in the eye.  We all know this.  We also well know the expression, “He couldn’t look me in the eye.”  
 
So, this is why Uwaydah cannot appear in court rooms or have his depositions taken, ever.  Because he can’t face people.  He can look no one in the eyes.  He knows the truth, and so he suffers from a terrible internal tension.   He’s too terrified.  His terror causes him to flee from the scene. 
 
A person who has this inner tension to the extreme, and hides truth through deception to an extreme, is an evil individual.  This is what defines evil.  A sociopath or psychopath doesn’t have this tension.  So, a sociopath, technically, is not considered evil.  
 
I know this sounds paradoxical, but there are people both in and out of jail, who seem totally lacking in conscience.  Psychiatrists call them psychopaths or sociopaths.  Uwaydah is not a sociopath.  I heard from a caller last year, who told me he had talked to Rene Thomas Folse, who is a workers’ compensation defense attorney and also a PhD psychologist, that Folse said to him that Uwaydah is a sociopath.  But if Folse really said this, he is wrong.  A sociopath is not what Uwaydah is at all.
 
Sociopaths, feeling guiltless, commit crimes with reckless abandon, without a conscience, and their criminality is never characterized by scapegoating. They have no consciousness of guilt, so they feel guiltless and have an extreme lack of worry or concern.  Judges often give heavier sentences to these types, because of their lack of a feeling of guilt, and also because of their regular lack of any feeling of remorse.
 
But evil types can be even more terrifying as they are very different.  They have huge concerns.  And Uwaydah falls into this class of types.   He’s not a psychopath or a sociopath; he’s just evil.  He is very concerned with his crimes, and about putting on a false front of appearing good while showing and preserving a self-image of perfection. 
 
He hides.  He won’t show his face.  He ran away and took flight when Kelly Soo Park was arrested in June of 2010 and would not talk to the Santa Monica police.  He will not speak to the Federal Bureau of Investigation and the Secret Service, both which are agencies that want him for questioning.  He won’t return to California.

He split the scene and ran from these agencies, which shows a total consciousness of guilt.  His behavior belies an overwhelming inner understanding of his own guilt which he fights against with all his might and hides from himself in a condition of total self-deception.  He is right out of M. Scott Peck’s brilliant book:  People Of The Lie.   Peck writes:
 
“The words ‘image’, ‘appearance’, and ‘outwardly’ are crucial to understanding the morality of the evil.  While they seem to lack any motivation to be good, they intensely desire to appear good.  Their ‘goodness’ is all on a level of pretense.  It is, in effect, a lie.  This is why they are the ‘people of the lie.’”
 
This desire to appear good is the reason why Uwaydah so passionately sues people for libel, defamation and slander.  Uwaydah outrageously abuses people, but then when anyone confronts him about his abuses, opposes his actions, and most importantly, passes critical judgment upon him, he cries out, Slander!  He even included libel and defamation, and even malicious prosecution in his Santa Monica case against Khaled Ghandour, so this subject of Uwaydah in relationship to libel, defamation, and slander, is a subject for a long article all by itself. 
  
M. Scott Peck, one of the most brilliant psychiatrists of the 20th Century, who just died in 2005, is best known for his best selling classic, The Road Less Traveled.   But, in his seminal work, People Of The Lie, Peck perfectly describes Dr. Uwaydah with this quote, where he also borrows a quote from philosopher Martin Buber:
 
“Because they are such experts at disguise, it is seldom possible to pinpoint the maliciousness of the evil.  The disguise is usually impenetrable.  But what we catch are glimpses of ‘The uncanny game of hide-and-seek in the obscurity of the soul, in which it, the single human soul, evades itself, avoids itself, hides from itself.’”
 
That’s Uwaydah.  He hides from himself.  And he hides his true self from everyone.  He knows he’s a liar, thus, he can’t face other people because of his terror of being seen through.
 
I directly watched Judge Teresa Sanchez Gordon, in downtown Los Angeles in the Stanley Mosk Civil Court House, just two months ago in June 2011, struggle with the issue of imposing sanctions against Uwaydah for refusing to schedule his deposition within a timely period, in his civil action against his former business administrator, Marisa Schermbeck.  Judge Teresa imposed sanctions against Uwaydah, as he just wouldn’t cooperate to schedule a date and time for his deposition.  He came up with his excuses, even after defense lawyer Ryan Saba filed a motion to compel Uwaydah to appear for his deposition.

Finally, Judge Teresa wound up caving in to Uwaydah’s counsel, Mark Masters of the Bird firm, who demanded that it was reasonable for her to postpone the sanctions until late September, when Uwaydah’s Sharia court matter in Beirut would most likely be concluded.
 
In this case against Schermbeck, which is still on-going, Munir claims he can’t leave Lebanon and get to Los Angeles because his passports have been confiscated by the Sharia Court in Beirut, which is a family law court.  His wife has sued him for alimony.  And there’s this long drawn out story about why he has had to surrender his passports.   But, I’ll cut to the chase.
 
Uwaydah is using that Sharia court situation and milking it for all he can get out of it in order not to appear at Stanley Mosk court house in his case that he filed as Plaintiff against Marisa Schermbeck.  Remember, he can’t show up anywhere, as he’s an egregious liar and he can’t look people in the eye.  So, even if it be true that his wife in Beirut has sued him for alimony, he will milk it to the hilt for every excuse he can maneuver out of that situation with Sharia, just like he milked it with the case against Khaled Ghandour by theatrically stating he’d just had open heart surgery in Cleveland.  He didn’t appear in that case in Santa Monica in November of 2009 either.
 
He claimed at that time in late 2009, he had just had open heart surgery, and then there were complications.  So, he got his attorney, Richard Green, to file an ex-parte.  Here’s a section of the writing from that ex-parte:
 
We also discussed the fact that Dr. Uwaydah, a plaintiff herein, had unexpected open heart surgery the end of September and then most unexpectedly had complications from his open heart surgery and was in the hospital and undergoing (literally as we were meeting, I’m informed) additional procedures in Cleveland at the world renown heart center, the Cleveland Clinic. 
 
I informed Mr. Ghandour that it was highly unlikely that Dr. Uwaydah would be able to testify or participate in the trial November 2, 2009, since he was undergoing additional procedures, was on medication for pain and may even still be hospitalized at the time of trial.  However, earlier in the day, Dr. Uwaydah indicated that he would be able to testify via written declaration since he knew that the court wanted this case to proceed on schedule.
 
This is clear manipulation.  Uwaydah’s totally kissing up to the court by stating that he knows the court wants to proceed with this case on schedule.  He’s putting on this act that he’s being such a cooperator.  But it’s completely disingenuous. 
 
He may very well have had open heart surgery, but he is again milking it for all he can here with the theatrics about complications, additional procedures, pain, and medications.  Uwaydah preys on people’s compassion and sympathy.  Obviously, the judge not knowing Uwaydah is a master manipulator felt compassion for his situation.  Any true human being of feeling would feel compassion and desire to be giving and cooperate. 
 
His lawyer, Richard Green, goes on more in the same ex-parte:
 
I informed Mr. Ghandour that I would prefer a continuance but would acquiesce to my client’s desires and seek such an order for testimony via declaration.  I informed Mr. Ghandour that I did not want to “spring this” on the court at the last minute on November 2, 2009, the time set for trial. 
 
Therefore, I further informed Mr. Ghandour, at 4:00 pm on October 27th, 2009, that on October 29th 2009, I would appear ex-parte at 8:30 am in Department I of the courthouse located at 1725 Main Street, Santa Monica, California 90405 to seek an order that Dr. Uwaydah could testify at trial via declaration in lieu of personal appearance, although I suspected that the court would be reluctant to show such testimony at a trial.  I told him that, more realistically, I would also seek, therefore, a short continuance of the trial, in the alternative.
 
 
This is some pretty good play acting which is obsequious in its obeisance to the judge.  It plays on the judge’s human emotions, by saying in effect, “You are all powerful to decide whatever you want to do.  I bow down in obeisance as I lie here in a terrible state after open heart surgery; and I will testify by written declaration just to help you out to move the case forward, because I know that’s what you want—to clear cases off the calendar.  I will do what you want even if your choice is otherwise.  I’ll accept a postponement, if you desire.” 
 
It’s total, obsequious brown nosing.  A manipulator always tries to make the other person believe he’s doing him a favor. In this case, he even had an actor playing Khaled Ghandour, and one can only imagine the court scene on November 2nd, when the judge possibly asked the actor playing Ghandour if he would be willing to agree to Uwaydah testifying by written declaration!   Oh, what an act!  Of course, the actor is completely part of the plot, but the judge doesn’t know this.  The actor of Ghandour is on Uwaydah’s payola. 
 
The Ohio Federal District court in the year 2003 saw right through Uwaydah’s game of hide-and-go-seek.  This court called Uwaydah a fraudster outright, right in the court documents, for conning a one million dollar CT scanner out of General Electric Medical Systems Europe.  This court wrote:
 
Dr. Uwaydah repeatedly abused the discovery process and completely opposed the cooperative spirit intended by the Rules.  He has repeatedly failed to adequately respond to GEMS (General Electric Medical Systems) requests and this Court’s orders, which, in itself, warrants sanctions.  Most recently, Dr. Uwaydah has continued his delay tactics by avoiding his properly noticed deposition; and, thereafter, he failed to make a good faith effort to reschedule the deposition or otherwise make himself available.  Dr. Uwaydah’s counsel’s arguments in response to GEMS’ motion, especially in light of this case’s history, and this Court’s repeated willingness to allow counsel an opportunity to convince his client to cooperate, are unavailing.  This Court has patiently accommodated Dr. Uwaydah’s interchangeable excuses for his complete lack of cooperation.  Dr. Uwaydah has shown this Court his lack of respect for the judicial process and has demonstrated he will not remedy his actions in the future. 
 
Defense attorneys defending Uwaydah’s victims, both the willing and the unwilling, can always count on the fact that Uwaydah will never show up.  Without exception.
