Munir Uwaydah, M.D. versus Marissa Schermbeck Most Likely To Get Dismissed

Once again, another civil case filed by Dr. Munir Uwaydah against a defendant will most likely get dismissed within the next 90 days like so many other cases Uwaydah has filed over the past several years.

This morning in Los Angeles Superior Court, defense counsel Ryan Saba, representing Munir Uwaydah’s former business administrator, Marissa Schermbeck, appeared to further insist upon Uwaydah appearing in his office for his deposition so this case can move forward. This suit cannot move forward without Uwaydah’s deposition, and still the issue continues that Uwaydah is embroiled in a family law matter in Lebanon which has been brought against him by his wife, and cannot travel.
 
Munir Uwaydah, M.D. claims that his passports have been surrendered by order of the Lebanese Sharia court, a family and religious court which presides over family and probate matters. A statement has been filed by the defense, of a legal expert stating that Uwaydah could easily appear in the Sharia court and request his passports returned, pay a minimal fine of about $1,500 to re-obtain the use of his passports, or resolve the matter with his wife in order to be able to return to Los Angeles to have his deposition taken.

But the judge, Teresa Sanchez-Gordon, expressed that she continues to be confused by how all this passport suspension occurred.
 
Judge Teresa Sanchez-Gordon: This family law case in Lebanon in the Sharia Court was filed July 8, 2010. And I’m not sure where Dr. Uwaydah was in November (when the current L.A. civil case was filed). I’m not sure if he had surrendered his Passport back in July, August, September, October or any time prior to November 19th and whether he was allowed to leave the country, not leave the country, what brought up this issue ever surrendering, who ordered it, when it was ordered? That’s not clear to me.
 
Most matters concerning Munir Uwaydah are never at all clear.  He plays games with the courts, designs ruses, makes excuses for not cooperating with discovery, and then most often drops the cases after he has depleted his opponents of a great deal of money. 
 
He dismissed his case against me for libel back in January 2011 without prejudice.  He never even served me with the Complaint.  It seems his tactics are simply to scare his opponents into surrendering early out of a fear of high litigation costs.

He dismissed his case against Cindy Ogden and her partner Jeff Holmes just two weeks ago. The case was about Uwaydah’s claim that Ogden and Holmes refused to sell him a hospital in Monrovia which Uwaydah insisted they had a solid contract on.  Uwaydah went on for four years pursuing the case and eventually demanded one million dollars to settle. But Ogden and Holmes refused to pay Uwaydah a million dollars. So, finally… case dismissed.
 
Now, it seems completely inevitable that Uwaydah will dismiss this case against Marissa Schermbeck which he has filed against her for conversion, constructive fraud, breech of fiduciary duty, unjust enrichment, bla bla… There have been several other law suits filed by Uwaydah against other former employees which were filed, initiated, and then dropped…
 
This time in court, Mitchell Kamin from the Bird firm (Bird, Marella, Boxer, et al) represented Uwaydah and Frontline Medical and said that they might very shortly in light of the situation file a dismissal.

Judge Teresa Sanchez-Gordon: We cannot get Dr. Uwaydah here because he doesn’t have his passport. They’ve asked that they return it. He’s suggested putting up a bond. They rejected that. Apparently his wife spoke in favor of not allowing him to obtain his passport again and that request was granted. So we have a person who has brought this lawsuit, cannot move forward on the lawsuit because we cannot move forward without his deposition.
 
He brought this lawsuit. He needs to be deposed. And I recall the last appearance someone said -- I don’t know if it was you, Mr. Saba, you said I’m not going to Lebanon. We do not want to go to Lebanon and I can understand that. I'm not going to force defense to go to Lebanon.
 
Thus, the judge gave Uwaydah 90 more days to get back to L.A. and litigate this case or she is going to dismiss it without prejudice.
 
Apparently also, Uwaydah does not like my reportings here in my publication as he has had Benjamin Gluck of the Bird firm try to buy me out by secretly using an agent to approach me about the possibility of buying www.adjustercom.com.  While in communication with this agent by email, I saw that she copied her response to me to Benjamin Gluck also.  That was a dead giveaway that it was Uwaydah trying to pay me off and silence my reportings. 
 
Thus, when I saw that she had cc’d Benjamin Gluck I ceased all communication.
 
Still, there are tens of millions of dollars in medical liens from Frontline Medical filed with the WCAB against numerous carriers and TPAs. In spite of the fact that Frontline has contracted to a shadow of the size it used to be, the liens are still out there and will most likely cost the workers’ compensation system in California millions more just to merely settle them for “nuisance value”.
