Cara Cruz-Thompson To Be Tried Separately Now In The AIG/Matrix Embezzlement Case

It is evident by now that Cara Cruz-Thompson, one out of the four defendants in the AIG/Matrix embezzlement scheme, has made the move to be tried separately from her husband, Hector Porrata, and from the other two defendants: Rene Montes and George Martinez.

I received an email last week on Wednesday, January 20th, from a reader who merely wrote, “Are you going to write about yesterday?”  This question to me was certainly infinitely vague, as I did not know what had gone on yesterday.  So I replied that I guessed she was asking about the Porrata, Cruz-Thompson, Montes, and Martinez case, and if so, the Preliminary Hearing was on a Continuous Waiver and Court would resume on January 25th.

My reader then replied, “Yes, I was talking about that case.  It looks like Cara’s arraignment was held yesterday and was heard.  It looks like her next arraignment will be in March.  I was just wondering if you knew anything about that.” 

What?  Cara’s arraignment?  Excuse me?  Cara’s arraignment was held back in May 2009 together with Hector, Rene and George.   So, my immediate thought was she must have split off from the group with her new attorney and is now going to be tried separately.  Thus, I replied to the reader and asked several questions.  But, I got no further replies.  Why is it that when I start asking people questions they suddenly go silent and disappear?

On Tuesday morning, January 26th, Judge Elaine Streger called the Court to order by announcing, “Court is now in session in the People versus Hector Porrata, Rene Montes, and George Martinez.”  This was the first time that she or the District Attorney, Thomas Schultz, had called the Court to order and left off Cara’s name.   So, this was a clear sign that Cara is now out of this Preliminary Hearing and upcoming Trial, and is being tried separately. 

It’s most likely a good move and is better for Cara not to be in the same Court Room day after day with Hector.  All Hector does when he’s in Court with Cara is stare and her, gape at her, and talk to her.  On the first day back in Court after the Christmas and New Year’s break, I thought that Deputy who was leaning against the jury box was going to blow a gasket when he yelled at Hector to stop talking to Cara.  I remember how he yelled out to Hector, “Are you going to just ‘dis me like that?”  I had never heard that expression before: ‘dis me.  I guessed it meant dismiss me. 

But, now Hector does not have Cara as a distraction any longer.  He just sits there with a lonely vacant stare on the right end of the other two defendants from the perspective of the audience seats, in his little chain gang with George in the middle and Rene on the left. George always wears dark blue like Hector, but Rene Montes always prefers to wear Orange.  They sit hand-cuffed to the arms of those three contiguous chairs facing the attorneys’ backs before the Judge and the Witness. 

Hector’s hair is dark brown with white flecks in it, cropped very short.  Sometimes I stare at his face and his hair as he sits there, and I wonder what it would be like to get inside his head.  His face is a little gaunt and he is starting to develop some slight jowls.  He has to sit there and just listen as mounds and mounds of evidence are brought against him.  Cara does not have to sit there as documents from file after file are brought up as Exhibits by the DA before Witness, Linda White, pertaining to liens Cara paid to WCSC & Associates, while WCSC & Associates paid a fraction to the real lien holder relative to what Cara paid WCSC and Rene Montes. 

The defense lawyers are very good lawyers and sometimes I hear them come up with bullshit arguments; or else they just ask questions of the witnesses which really go nowhere.  At the ends of their questioning I often can’t even figure out what their points were.  Maybe there really weren’t any.  They are standing up and questioning because they have to do something to try and defend their clients. They can’t just sit there and do nothing while they get buried under tons of evidence.  Sometimes I try to get inside their heads too and imagine how they must feel with such overwhelming evidence stacked up against their clients.  What else can they do?

I will try to describe all the evidence to you, my readers, over these next several days.  It is so overwhelming that I am struggling with where to start.   But, I’m sure if I wait a bit I will find my way…
