Fraud Suspects Bugged by New Legislation

If everything goes as planned, fraud investigators will soon have one more weapon in their arsenal, compliments of SB 1541.

The legislation contained in the bill modifies the California Penal Code to allow Department of Insurance (DOI) investigators the ability to obtain wiretap evidence.

Wiretap evidence lawfully gathered by DOI peace officers or anyone acting under their direction would then be admissible in court.

One caveat is that the DOI would need to have a written policy that governs the acceptable procedures for wiretapping. And an investigator must first get authorization from a supervisor before wiretapping methods could be employed.

The law would also require the agency’s written policy to be kept on file at the Attorney General’s office.

Privacy advocates are against the legislation, but those who are fed up with picking up the tab to cover fraud are all for the bug bill.
