Kerfuffle Raised By Plaintiffs' Lawyers Over 'Post Loss Underwriting' By Pauline Grant - August 6, 2008
Insurance fraud expert and California lawyer, Barry Zalma, writes in detail about the kerfuffle raised by the plaintiffs' lawyers claiming that insurers engage in "post loss underwriting."
Mr. Zalma explains in the August 1, 2008 issue of Zalma's Insurance Fraud Letter (ZIFL) that "post loss underwriting is an oxymoron." Mr. Zalma said "underwriting is a risk taking practice performed before a policy is issued." Rescission is an equitable remedy available since the first court of equity sat in England about 600 years ago and allows an a person who was deceived into entering into a contract to return to the status quo."
